Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Lumeria Labs, Inc. ("Lumeria", "we", "us", or "our") governing your use of the Lumeria app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using it, you represent that you meet this requirement and that the information you provide is accurate.

2. The Service

Lumeria lets you capture skin scans, track metrics and trends over time, log lifestyle inputs, and receive AI-generated optimization suggestions and chat guidance. We may add, change, or remove features at any time.

3. Not medical advice, important

Lumeria is a wellness and self-optimization tool, not a medical device, and it does not provide medical advice, diagnosis, or treatment. Our AI guide ("Lumi") is a coach, not a doctor: it may describe what it observes and suggest lifestyle levers, but it does not diagnose conditions or claim to treat or cure anything.

Scores and suggestions may be inaccurate or incomplete and should not be relied on for medical decisions. Always consult a qualified dermatologist or other healthcare provider for any medical concern, and seek emergency care for urgent issues. Your use of AI-generated content is at your own discretion and risk.

4. Your account

If you create an account, you are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Upload content you do not have the right to use, or photos of anyone who has not consented.
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service or its providers.
• Use the Service to provide medical, diagnostic, or clinical services to others.
• Misuse the AI features to generate harmful, deceptive, or infringing content.

6. Your content

You retain ownership of the photos, notes, and other content you provide ("Your Content"). You grant us a limited license to process Your Content solely to operate and provide the Service to you, for example, to compute metrics on your device and, when you request it, to transmit the necessary data to our AI provider to generate a response. We do not claim ownership of Your Content and do not use it for advertising.

7. AI features and limitations

AI features depend on third-party models and network connectivity, and may be unavailable, delayed, or produce inaccurate results. AI-generated output is labeled in the app and is provided "as is" for informational purposes. You are responsible for how you use it, consistent with the "Not medical advice" section above.

8. Subscriptions and payments

Some features may require a paid subscription. Where subscriptions are sold through an app store, billing, renewals, and cancellations are handled by that store under its terms, and prices and availability may change. Any free trials or promotional terms will be described at the point of purchase.

9. Intellectual property

The Service, including its software, design, and trademarks, is owned by Lumeria Labs, Inc. or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms.

10. Third-party services

The Service relies on third parties (including our AI, authentication, hosting, and app-store providers). Your use of those services may also be subject to their terms and privacy policies, and we are not responsible for their acts or omissions.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will be accurate or reliable.

12. Limitation of liability

To the fullest extent permitted by law, Lumeria Labs, Inc. and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. To the extent liability cannot be excluded, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim or USD $50.

13. Indemnification

You agree to indemnify and hold harmless Lumeria Labs, Inc. and its providers from any claims, damages, or expenses arising from your misuse of the Service, your content, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (such as disclaimers, limitation of liability, and governing law) will survive.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. You agree that the courts located there will have exclusive jurisdiction, except where applicable consumer-protection law gives you the right to bring a claim in your local courts. Nothing in these Terms limits any non-waivable statutory rights you have.

16. Changes to these Terms

We may update these Terms from time to time. When changes are material, we will update the effective date and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance.
